Faculty Accomplishments October 2006

Derek Bambauer had an "in reply" published in Arch Neurol Vol. 63, Oct. 2006.

Associate Professor of Law Linda Beale was elected president of Central States Law School Association for 2007.

Professor Beale also presented a paper on Davis and the Supreme Court's dormant Commerce Clause jurisprudence at the 2006 Central States Law School Association Conference and Annual Meeting at the University of Louisville School of Law.

Assistant Professor of Law Jocelyn Benson was invited by the Fordham Urban Law Review to author an article. The piece she is writing is tentatively entitled: "Voter Fraud or Voter Defrauded? Federal Courts and the Issue of Fraud in Elections," based on a talk she delivered on October 23, 2006 at Drake Law School in Des Moines, Iowa. The issue is set to be published in Fall 2007.

On October 24, 2006, Professor Benson moderated a panel discussion in the Partrich Auditorium consisting of the six Wayne State law student research assistants she hired through work study this summer to examine and document the potential impact of Proposal 2, should it pass, on educational and economic opportunities in Michigan. The panel was sponsored by the Student Board of Governors and nearly 60 students and other community members attended the discussion.

On October 25, 2006, Professor Benson addressed students at the University of Toledo Law School on "Election Protection: Issues in 2004 and Beyond" to a gathering of approximately 75-80 students. The lecture included a presentation of the themes and arguments in her article, "Su Voto Es Su Voz: Incorporating Limited English Proficient Citizens into American Democracy" Boston College Law Review (forthcoming 2007).

Professor Benson completed the Detroit Free Press Marathon on October 29, 2006, in just over four hours.

Professor of Law Stephen Calkins spoke on Private Enforcement at the U.K. Office of Fair Trading Workshop on Private Enforcement of Competition Law (London, Oct. 19-20, 2006)
He was also named chair of the Centers and Institutes Advisory Committee at WSU.

Assistant Professor of Law Lance Gable published The Legal Framework for Meeting Surge Capacity Through the Use of Volunteer Health Professionals During Public Health Emergencies and Other Disasters, in the Journal of Contemporary Health Law and Policy, (22 J. CONTEMP. HEALTH L. & POL'Y 5 (2006)), with co-authors James G. Hodge and Stephanie H. Cálves.

Professor Gable gave invited presentations on:

The intersection of law and the use of public health and environmental data to protect health at the CDC's National Environmental Public Health Tracking Program meeting in Atlanta, Georgia (August 2006); and

The threat of pandemic flu and the need for legal preparedness at the American Association of Law Librarians Annual Meeting, St. Louis, MO (July 2006).

Professor Gable co-chaired a working group on law, policy, and mental health at the Wayne State University Institute of Mental Health's inaugural symposium (September 2006).

He also led discussions in six Montana cities on a draft proposal to modernize Montana's state public health laws (June 2006). He is the lead drafter of this legislation, which may be introduced this coming legislative term.

Professor of Law Ralph Slovenko was a co-facilitator at the WSU Institute of Mental Health Organizational Symposium from work group #6, Mental Health Policy.

David Moran 's article, "Don't Worry, I'll Be Right Back: Temporary Absences of Counsel During Criminal Trials and the Rule of Automatic Reversal," was published at 85 Nebraska Law Review 186 (2006).

Professor of Law Michael McIntyre participated in the December 2005 meeting in Geneva of the Committee of Experts on International Cooperation in Tax Matters, working with members from developing countries on tax treaty issues. He was appointed to serve on a subcommittee to address the exchange of information provision in the UN Model Tax Convention and will present on that topic at the 2006 meeting of the committee, scheduled for October 30 to November 3.
He also wrote a detailed commentary criticizing the OECD proposal for mandatory and secret arbitration of certain international tax disputes. A revised version of that paper is scheduled for publication in the Florida Tax Review. Senators Byron L. Dorgan, Russ Feingold, and Carl Levin cited and attached his commentary in a letter to Treasury Secretary John W. Snow that raised questions about the merits of the OECD proposal.
On April 8, 2006, Professor McIntyre presented a draft paper on tax competition at the Critical Tax Theory conference held at Mercer Law School. That paper was excerpted from the draft of a book on European taxation that he is writing with some Dutch colleagues.
On July 6-8, 2006, he participated in the Jean Monnet Conference "Tax Compliance Costs for Companies in an Enlarged European Community," held at Rust, Austria. He spoke at the conference on the use of combined reporting with formulary apportionment as a possible solution to the problems that members of the EU are having with their corporate income tax. Professor McIntyre returned to Europe on July 24 to participate in a side event at the ECOSOC meeting at the United Nations Office in Geneva. The event was sponsored by the Tax Justice Network in cooperation with the South Center. He offered a proposal for a Code of Conduct that would encourage countries to assist each other in preventing international tax evasion and capital flight.

Daniel Manville was honored for the 5th year by the Federal Bar Association, Eastern District of Michigan Chapter, at the annual State of the Court Luncheon for his Pro Bono work for the Court. Seven WSU Law School students were also honored.

Professor of Law Peter Henning had an article published on Law.com: "Did E-Mail Use Cause a Disconnect for HP Lawyers?" on September 27, 2006.

Assistant Professor of Law Noah Hall gave an invited presentation on September 29, 2006, at the University of Michigan Law School's symposium "The Great Lakes: Reflecting the Landscape of Environmental Law." His presentation was entitled, "Transboundary Pollution: Harmonizing International and Domestic Law," and is the basis for an article being published by the University of Michigan Journal of Law Reform.

His article "Bilateral Breakdown: U.S.-Canada Pollution Disputes" was just published iat 21 Natural Resources & Environment 18 (2006).

Professor of Law Gregory Fox gave a talk on "Regulation of Anti-Democratic Actors" at the Annual Colloquium on International Human Rights in Athens, Greece in June 2006.

He gave a talk on the occupation of Iraq at the Institute for International Law, Ludwig-Maximilians-University Munich, Germany in May 2006.

Professor Fox spoke on a panel at Widener Law School on Democratizing International Organizations in April 2006.

He is writing the entries on "Regime Change" and "Protection of the International Right to Democracy" for the Encyclopedia of Public International Law, published by the Max Planck Institute in Heidelberg, Germany

Professor Fox co-authored a brief to the DC Circuit in Nemariam v. Commercial Bank of Ethiopia, an appeal dealing with the question of whether intangible property is covered by the "international takings" exception to the Foreign Sovereign Immunities Act.

Erica Eisinger will speak to the paralegal section of the Detroit Metropolitan Bar Association on October 24, 2006, on "Ethical Issues Facing Paralegal Professionals in Practice."

She is co-author, with Adjunct Prof. Daniel E. Manville and Kelly Rimmer (WSU J.D. ‘06; law clerk to the Hon. Denise Page Hood), of an article forthcoming in The Wayne Law Review annual survey issue on Prisoner's Rights.

Professor of Law Stephen Calkins was one of four "master" teachers at the American Bar Association Section of Antitrust Law Antitrust Masters Course III, Sept. 28-Oct. 1, at Kiawah Island, South Carolina.

Professor Calkins was awarded the Donald H. Gordon teaching award at Wayne State Law School in September 2006.

The Provost and the Academic Senate Policy Committee have appointed Professor Calkins chair of the University's Type I Centers and Institutes Advisory Committee.

Assistant Professor of Law Jocelyn Benson presented "The Current status of Civil Rights Laws and Litigation in 2006," for the panel on Eyes on the Prize and Modern-Day Civil Rights, Wayne State University Undergraduate College on September 27, 2006.

She also spoke on "The Voting Rights Act Reauthorization of 2006 and Limited English Proficiency Voters," for the panel on the Reauthorization of the Voting Rights Act, Emory Law School, Atlanta, Georgia, on October 7, 2006.

Professor Benson delivered a keynote address, "Voter Fraud or Voter Defrauded? Federal Courts and the Issue of Fraud in Elections," at Drake Law School, Des Moines, Iowa, on October 23, 2006.
